Abstract

Problem/Background (GAP Gambling in Banda Aceh has become a serious issue as it violates Islamic law, specifically Qanun Aceh Number 6 of 2014 concerning Jinayat Law. Despite clear prohibitions, gambling practices remain widespread due to low public awareness and weak law enforcement. The Civil Service Police Unit (Satpol PP) and Wilayatul Hisbah (WH), who are supposed to be at the forefront of enforcing the law, have not demonstrated optimal performance. Therefore, it is necessary to examine the extent of their role in handling these cases through a judicial approach. Purpose To analyze the role of Satpol PP and Wilayatul Hisbah in handling gambling cases in Banda Aceh based on the implementation of Islamic law. Method: This study uses a descriptive qualitative approach with data collected through interviews, observations, and documentation involving Satpol PP officers, WH personnel, community leaders (Tuha Peut), and local residents. The data analysis is based on the role theory of Biddle and Thomas (in Sarwono, 2015), which consists of five elements: expectation, norm, performance, evaluation, and sanction. Results/Findings: The research findings indicate that the role of Satpol PP and WH in tackling gambling in Banda Aceh has not been effective. The public has high expectations for firm law enforcement; however, reports are often not followed up effectively due to fear and poor coordination. Although there are established SOPs for handling gambling cases, their implementation is still weak due to limited understanding among personnel. Gambling case data fluctuated over the years: 35 cases in 2020, 48 in 2021, a decrease to 27 in 2022, and a rise again to 36 in 2023, reflecting inconsistent enforcement. Both the community and internal evaluations highlight shortcomings in personnel performance, infrastructure, and the effectiveness of patrol operations. Sanctions imposed tend to be administrative or educational in nature, while jinayat punishments such as whipping or fines are rarely applied due to the lack of qualified investigators and weak legal processes. Conclusion:The role of Satpol PP and Wilayatul Hisbah in addressing gambling cases in Banda Aceh has not been optimal due to several hindering factors, such as limited personnel, poor understanding of SOPs, and inadequate operational facilities. Additionally, the weak implementation of strict sanctions and the lack of collaboration with community figures further reduce the effectiveness of law enforcement. Thus, strengthening institutional capacity, improving coordination, and enforcing more consistent and firm legal actions are essential to ensure the full implementation of Islamic law.
