Abstract
ABSTRACT Problem/Background (GAP): Various legal products have been provided by the government to all levels of Indonesian society in regulating the order of life in order to avoid infection with the Covid-19 virus, among such legal products as Presidential Decree No. 12 of 2020 concerning Determination of Non-Natural Disasters Covid-19 19, and Presidential Decree No. 11 of 2020 concerning Health Emergencies. This rule is the basis for implementing the handling of the pandemic in Indonesia. In Sinjai Regency, the legal product that is the basis for handling the pandemic is the Sinjai Regent Regulation Number 27 of 2020 concerning Health Protocol Discipline as the basis for implementing Health Protocol law. Objectives: The purpose of this research is to determine the enforcement of Health Protocol law in Sinjai district, to find out the inhibiting factors of law enforcement and also how the efforts made by the Sinjai Satpol PP in solving problems from existing obstacles. Methods: This study uses a qualitative research method with an inductive approach, using primary and secondary data obtained through interviews, documentation and field observations. Conclusion: this study proves that the Health Protocol law enforcement carried out by the Satpol PP of Sinjai Regency is classified as good according to the dimensions of law enforcement, namely rules, control methods, and implementation of punishment. In enforcing the Health Protocol law, there were several obstacles that were found by the Satpol PP Sinjai, such as a lack of budget for activities, hoaxes in the community, and resistance from the community. The efforts made by the Sinjai Satpol PP in dealing with these obstacles include cutting the salaries of temporary employees, issuing decrees for each activity, equipping members with legal materials, and vaccinating the Sinjai community. Keywords: Law Enforcement, Covid-19, Health Protocol ASTRAK Permasalahan/Latar Belakang (GAP): Berbagai produk hukum telah diberikan oleh pemerintah kepada segenap lapisan masyarakat Indonesia dalam mengatur tatanan kehidupan agar bisa terhindar dari inveksi virus Covid-19, diantara produk hukum itu seperti Kepres No 12 Thn 2020 Tentang Penetapan Bencana Nonalam Covid-19, dan Kepres No 11 Thn 2020 Tentang Kedaruratan Kesehatan. Aturan inilah yang menjadi dasar dalam pelaksanaan penanganan pandemi di Indonesia. Untuk di Kabupaten Sinjai produk hukum yang menjadi landasan penanganan pandemi adalah Peraturan Bupati Sinjai Nomor 27 tahun 2020 Tentang Disiplin Protokol Kesehatan sebagai landasan penegakan hukum Protokol Kesehatan. Tujuan: Tujuan dari peenelitian ini adalah untuk mengetahui penegakan hukum Protokol Kesehatan di kabupaten Sinjai, mengetahui faktor penghambat penegakan hukum dan juga bagaimana upaya yang dilakukan oleh Satpol PP Sinjai dalam menyelesaikan masalah dari kendala yang ada. Metode: Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan induktif, menggunakan data primer dan sekunder yang diperoleh melalui wawancara, dokumentasi dan observasi dilapangan. Kesimpulan: penelitian ini membuktikan bahwa penegakan hukum Protokol Kesehatan yang dilakukan oleh Satpol PP Kabupaten Sinjai tergolong baik sesuai dengan dimensi penegakan hukum yakni aturan, metode penertiban, dan implementasi hukuman. Dalam penegakan hukum Protokol Kesehatan terdapat beberapa hambatan yang didapati Satpol PP Sinjai seperti kekurangan anggaran kegiatan, hoax di masyarakat, dan perlawanan dari masyarakat. Upaya yang dilakukan Satpol PP Sinjai dalam menangani hambatan itu dengan pemotongan gaji pegawai honorer, pemberian SK disetiap kegiatan, membekali anggota dengan materi hukum, dan program vaksinasi masyarakat Sinjai.
