Abstract
ABSTRAK Minuman Keras menjadi salah satu masalah yang cukup sulit dipecahkan permasalahannya hingga saat ini , khususnya di Provinsi Papua Kabupaten Kepulauan Yapen yang masih sangat banyak diproduksi, diperjualbelikan dan dikonsumsi secara bebas. Minuman keras juga memberikan dampak negative dalam kehidupan bermasyarakat antara lain semakin tingginya angka kriminalitas, meningkatnya konflik yang terjadi di tengah masyarakat, Kekerasan dalam rumah Tangga (KDRT), dan masih banyak lagi. Lahir dari keresahan tersebut penulis mengambil judul Skripsi tentang “Efektivitas Kinerja Satuan Polisi Pamong Praja dalam Penegakan Minuman Keras di Kabupaten Kepulauan Yapen Provinsi Papua. Satuan Polisi Pamong Praja sendiri sebagai aparat pemerintah yang memiliki Tugas, Pokok dan Fungsi sebagai Penegak Peraturan Daerah, oleh sebab itu Satuan Polisi Pamong Praja dalam skripsi ini dijelaskan seberapa efektifkah tugas, pokok dan fungsi Satuan Polisi Pamong Praja dalam melaksanakan tanggung jawabnya. Penilitian ini menggunakan metode penelitian kualitatif deskriptif serta pendekatan normative, yuridis, dan sosiologis dengan menggunakan teknik pengumpulan data melalui wawancara dan dokumentasi. Sumber data yang digunakan adalah data primer dan sekunder serta data yang diperoleh dari Satuan Polisi Pamong Praja Kabupaten Kepulauan Yapen. Data dianalisis dengan menganalisis konten, naratif, dan wacana hingga menjadi sebuah kesimpulan berdasarkan teori efektivitas menurut Mardiasmo. Berdasarkan analisi yang dilakukan, diperoleh kesimpulan bahwa efektivitas kinerja Satpol PP Kabupaten Kepulauan Yapen dalam penegakan Perda Miras No. 4/2016 belum optimal. Temuan penelitian terdapat kendala internal dan eksternal. Kendala internal yaitu keterbatasan jumah personil dengan cakupan tugas serta kebiasaan dan mindset masyarakat sebagai kendala eksternal. Upaya yang dilakukan dalam penegalan Perda No. 4/2016 yaitu tindakan preventif dan represif berupa pemberian surat pemberitahuan dan sosialisasi kepada produsen minuman beralkohol, program sidak, dan patrol. Kata kunci : Perda Miras, Efektivitas ABSTRACT Liquor is one of the problems that is quite difficult to solve until now, especially in Papua Province, Yapen Islands Regency, which is still very much produced, traded and consumed freely. Liquor also has a negative impact on social life, including the increasing number of crime, increasing conflicts that occur in the community, Domestic Violence (KDRT), and many more. Born out of this anxiety, the author took the title Thesis on “The Effectiveness of the Performance of the Civil Service Police Unit in Enforcement of Liquor in the Yapen Islands Regency, Papua Province. The Civil Service Police Unit itself as a government apparatus has the Duties, Principals and Functions of Enforcing Regional Regulations, therefore the Civil Service Police Unit in this thesis explains how effective the duties, principal and functions of the Civil Service Police Unit are in carrying out their responsibilities. This research uses descriptive qualitative research methods as well as normative, juridical, and sociological approaches by using data collection techniques through interviews and documentation. Sources of data used are primary and secondary data and data obtained from the Civil Service Police Unit, Yapen Islands Regency. Data were analyzed by analyzing content, narrative, and discourse to arrive at a conclusion based on Mardiasmo's theory of effectiveness. Based on the analysis, it was concluded that the effectiveness of the Satpol PP of Yapen Islands Regency in enforcing the Perda on Alcohol No. 4/2016 has not been optimal. The research findings contained internal and external constraints. Internal constraints are the limited number of personnel with the scope of tasks as well as the habits and mindset of the community as external constraints. Efforts made in enforcing Regional Regulation no. 4/2016, namely preventive and repressive measures in the form of providing notification letters and socialization to alcoholic beverage producers, inspection programs, and patrols.
