Abstract

ABSTRACT Problem/Background (GAP): The management of traditional markets as vital public spaces faces various challenges, particularly in the context of law enforcement and spatial planning in developing cities. Purpose: This study aims to analyze the efforts of the Civil Service Police Unit (Satpol PP) of Ambon City in regulating street vendors at Mardika Market. Methods: This study employed a qualitative approach grounded in an interpretive paradigm to gain an in-depth understanding of the enforcement of order in the commercial area by the Civil Service Police Unit (Satpol PP) at Mardika Market in Ambon City. The study was guided by the theory of order enforcement proposed by Eviany and Sutiyo (2023), which conceptualizes enforcement as a structured process encompassing three main dimensions: actions (both repressive and persuasive), supporting instruments (regulations and enforcement personnel), and goals (public order and compliance). This theory was chosen for its comprehensive framework that integrates legal, institutional, and social approaches to public space regulation. Data were collected through in-depth interviews, direct observation, and documentation study. A total of nine informants participated in the study, including the Head of Satpol PP, the Head of Public Order and Security Division, the Head of Regional Regulation Enforcement Division, the Head of Operations and Control Section, and five street vendors operating in Mardika Market. The key informant was the Head of Satpol PP, selected due to his strategic position as the top decision-maker and implementer in the enforcement process, as well as his in-depth knowledge of planning, execution, and evaluation of market regulation. Data were analyzed inductively through stages of data reduction, presentation, and conclusion drawing to develop a comprehensive understanding of the effectiveness and challenges of market enforcement efforts. Results/Findings: The results show that the regulation of vendors has not been carried out optimally due to two main factors: (1) internal factors, including a lack of firmness in enforcing sanctions and insufficient dissemination of regulations to the public; and (2) external factors, such as low compliance among vendors with trading regulations, despite the availability of a more appropriate relocation site. Satpol PP tends to adopt a persuasive approach without being balanced by firm and educational law enforcement. Conclusion: The study concludes that the success of vendor regulation is significantly influenced by Satpol PP’s ability to combine repressive, educational, and participatory approaches in a balanced manner. Without extensive public outreach and an understanding of local regulations, regulatory efforts will only yield temporary results. This study supports previous findings regarding the importance of institutional capacity and public communication strategies in local law enforcement. ABSTRAK Permasalahan/Latar Belakang (GAP): Penataan pasar tradisional sebagai ruang publik vital menghadapi berbagai tantangan, khususnya dalam konteks penegakan hukum dan pengelolaan tata ruang di kota-kota berkembang. Tujuan: Penelitian ini bertujuan untuk menganalisis upaya Satuan Polisi Pamong Praja (Satpol PP) Kota Ambon dalam menertibkan pedagang di Pasar Mardika. Metode: Penelitian ini menggunakan pendekatan kualitatif berlandaskan pada paradigma interpretif untuk memahami secara mendalam proses penertiban kawasan perdagangan oleh Satuan Polisi Pamong Praja (Satpol PP) di Pasar Mardika Kota Ambon. Penelitian ini mengacu pada teori penertiban yang dikembangkan oleh Eviany dan Sutiyo (2023), yang memandang penertiban sebagai proses terstruktur yang mencakup tiga dimensi utama: tindakan (baik represif maupun persuasif), perlengkapan (aturan dan aparatur), serta tujuan (keteraturan dan kepatuhan). Teori ini dipilih karena memberikan kerangka yang komprehensif dalam menilai dinamika pelaksanaan penertiban dari aspek hukum, kelembagaan, dan pendekatan sosial. Data dikumpulkan melalui wawancara mendalam, observasi langsung, dan studi dokumentasi. Total sembilan informan dilibatkan, yaitu Kepala Satpol PP, Kepala Bidang Keamanan dan Ketertiban Umum, Kepala Bidang Penegakan Perda, Kepala Seksi Operasi dan Pengendalian, serta lima pedagang Pasar Mardika. Informan kunci ditetapkan adalah Kepala Satpol PP Kota Ambon, mengingat posisinya yang strategis sebagai pengambil kebijakan dan pelaksana utama dalam proses penertiban, serta pemahamannya yang mendalam terhadap seluruh tahapan perencanaan hingga evaluasi penertiban. Hasil/Temuan: Hasil penelitian menunjukkan bahwa penertiban pedagang belum berjalan secara optimal akibat dua faktor utama: (1) faktor internal berupa lemahnya ketegasan dalam pemberian sanksi dan minimnya sosialisasi peraturan kepada masyarakat; dan (2) faktor eksternal berupa rendahnya kepatuhan pedagang terhadap aturan berjualan, meskipun telah tersedia lokasi relokasi yang lebih layak. Satpol PP cenderung menerapkan pendekatan persuasif tanpa diimbangi dengan penegakan hukum yang tegas dan edukatif. Kesimpulan: Kesimpulan dari penelitian ini adalah bahwa keberhasilan penertiban sangat dipengaruhi oleh kemampuan Satpol PP dalam menggabungkan pendekatan represif, edukatif, dan partisipatif secara seimbang. Tanpa sosialisasi yang masif dan pemahaman masyarakat terhadap regulasi, penertiban hanya akan bersifat sementara. Penelitian ini memperkuat temuan sebelumnya terkait pentingnya kapasitas kelembagaan dan strategi komunikasi publik dalam penegakan hukum lokal. Kata Kunci: Penertiban, Pedagang, Satpol PP
