Abstract
ABSTRACT Problem/Background (GAP): The enforcement of Regional Regulation (Perda) Number 2 of 2019 in Nabire Regency regarding market operations on Sundays has not been running optimally. This is due to several obstacles, such as frequent violations, resistance from traders, and a lack of public legal awareness. This issue is important to study as it relates to public order and the respect for religious values of the predominantly Christian community in the region. Purpose: To analyze the enforcement efforts of Regional Regulation Number 2 of 2019 concerning Sunday Market Operations by the Civil Service Police Unit (Satpol PP) in Nabire Regency, Central Papua Province. Method: This study uses a qualitative descriptive approach with purposive sampling techniques. Informants consist of Satpol PP officers, local government officials, and community members who are directly involved in or affected by the implementation of the regulation. Results/Findings: The enforcement of the regulation has not been optimal due to limited human resources, lack of facilities and infrastructure, low public awareness of regulations, and opposition from some traders who rely on Sunday market activities. Nevertheless, Satpol PP has undertaken various efforts such as budget optimization, SOP-based law enforcement, interagency cooperation, community education, and the imposition of measured sanctions. Conclusion: A more humanistic approach to law enforcement, increased public outreach, and adequate budgetary and infrastructural support are needed to improve the effectiveness of the implementation of Regional Regulation Number 2 of 2019 in Nabire Regency. Keywords: Regulation Enforcement, Market Operations, Civil Service Police Unit (Satpol PP), Sunday, Nabire Regency ABSTRAK Permasalahan/Latar Belakang (GAP): Penegakan Peraturan Daerah (Perda) Nomor 2 Tahun 2019 di Kabupaten Nabire mengenai operasional pasar pada hari Minggu belum berjalan optimal. Hal ini disebabkan oleh sejumlah kendala seperti pelanggaran yang masih marak, resistensi pedagang, dan kurangnya kesadaran hukum masyarakat. Permasalahan ini penting dikaji karena berkaitan dengan ketertiban umum serta penghormatan terhadap nilai-nilai religius masyarakat mayoritas Kristen di wilayah tersebut. Tujuan: Untuk menganalisis upaya penegakan Peraturan Daerah Nomor 2 Tahun 2019 tentang Operasional Pasar pada Hari Minggu oleh Satuan Polisi Pamong Praja di Kabupaten Nabire, Provinsi Papua Tengah. Metode: Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan teknik purposive sampling. Informan terdiri dari aparat Satpol PP, pejabat pemerintah daerah, serta masyarakat yang terlibat langsung atau terdampak oleh penerapan Perda. Hasil/Temuan: Penegakan Perda belum berjalan optimal akibat keterbatasan sumber daya manusia, kurangnya sarana dan fasilitas, rendahnya kesadaran masyarakat terhadap aturan, dan penolakan dari sebagian pedagang yang bergantung pada aktivitas pasar Minggu. Meski demikian, Satpol PP telah melakukan berbagai upaya seperti optimalisasi anggaran, penegakan hukum berbasis SOP, kerja sama lintas instansi, edukasi masyarakat, dan pemberian sanksi secara terukur. Kesimpulan: Diperlukan pendekatan penegakan hukum yang lebih humanis, peningkatan sosialisasi terhadap masyarakat, serta dukungan anggaran dan sarana yang memadai untuk meningkatkan efektivitas pelaksanaan Perda Nomor 2 Tahun 2019 di Kabupaten Nabire.
