Abstract
Background (Problem Statement / GAP):This study is motivated by issues surrounding violations of regional legal products concerning waste management and sanitation in the city of Manado. The increasing population has led to a rise in waste generation, which has implications for public order and peace due to unmanaged waste accumulation. In response, the Manado City Government issued regional regulations aimed at improving waste management to ensure public health and enhance the city's aesthetics. However, violations of these regulations are still commonly found in practice.Objective: The objective of this research is to describe the efforts of the Civil Service Police Unit (Satpol PP) of Manado City in enforcing the Regional Regulation on Waste Management. Method: This study uses a qualitative research method with a descriptive approach. Data were collected through structured interviews with Satpol PP members, business owners, and community members, as well as through observations and document analysis. The data analysis techniques used include data reduction, data presentation, and conclusion drawing. Findings: The results show that Satpol PP has made efforts to enforce the waste management regulation. Based on interviews and observations using the legal enforcement theory by Soerjono Soekanto, several factors were identified:Legal Factor: The enforcement of Regional Regulation No. 1 of 2021 is supported by legal certainty, as it is based on a clear legal framework. However, legal effectiveness remains low due to a lack of public awareness and the tendency of some people to ignore the rules. Although Satpol PP has conducted socialization and monitoring, public legal awareness remains a major challenge.Law Enforcement Apparatus Factor: The number of Satpol PP personnel is still below the national standard, and there is still a negative perception among the public regarding the attitude of officers. Nevertheless, enforcement strategies such as regular patrols, on-the-spot enforcement (OTT), and collaboration with the prosecutor's office have been relatively effective in deterring violators. Facilities and Infrastructure Factor: Supporting facilities such as CCTV, complaint applications, and operational vehicles are available, but many vehicles are often damaged, hampering enforcement operations. In terms of budget, although there has been an increase, there is still no specific honorarium provided for Satpol PP field officers, which affects their motivation. Community Factor:Community participation is relatively good, as reflected by public reporting of violations and mutual reminders regarding waste disposal schedules. Legal awareness has improved, evidenced by a yearly decline in the number of violations. The role of community leaders and government outreach has significantly supported this progress. Cultural Factor: The clean culture among Manado residents supports compliance with the regulation. Local residents are generally compliant, although some newcomers are still unfamiliar with the rules. Legal awareness is shaped by social values and government education, but further outreach is needed to ensure wider understanding. Conclusion:The conclusion of this study is that the enforcement of Regional Regulation No. 1 of 2021 concerning Waste Management in the City of Manado has been carried out properly. However, several obstacles remain, and improvements are needed to overcome these challenges and enhance the effectiveness of waste regulation enforcement in Manado. ABSTRAK Permasalahan/Latar Belakang (GAP): Penelitian ini dilatarbelakangi oleh Penulis berfokus pada permasalahan mengenai pelanggaran produk hukum daerah tentang pengelolaan sampah dan penyelenggaraan kebersihan di Kota Manado. Tujuan: Tujuan penelitian ini adalah untuk mendeskripsikan bagaimana upaya Satuan Polisi Pamong Praja (Satpol PP) Kota Manado dalam menegakkan Perda Persampahan. Metode: Metode yang digunakan adalah penelitian kualitatif dengan pendekatan deskriptif. Data diperoleh melalui wawancara terstruktur dengan anggota Satpol PP, pengusaha, dan masyarakat, serta observasi dan studi dokumentasi. Teknik analisis data meliputi reduksi data, penyajian data, dan penarikan kesimpulan. Hasil/Temuan: Hasil penelitian menunjukkan bahwa Satpol PP telah melakukan upaya penegakan dalam menegakkan perda persampahan yang dimana dari hasil wawancara dan observasi berdasarkan teori oleh Soerjono Soekanto untuk mendeskripsikan upaya penegakan.didapati Faktor Hukum Penegakan Perda No. 1 Tahun 2021 didukung oleh kepastian hukum karena adanya dasar peraturan yang jelas. Namun, efektivitas hukum masih rendah karena banyak masyarakat belum memahami atau menyepelekan aturan. Upaya Satpol PP seperti sosialisasi dan pengawasan telah dilakukan, tetapi kesadaran hukum masyarakat masih menjadi tantangan.Faktor Penegak HukumJumlah personel Satpol PP belum ideal sesuai standar nasional, dan masih ada persepsi negatif masyarakat terhadap sikap petugas. Meski begitu, strategi penegakan seperti patroli rutin, OTT, dan kerja sama dengan kejaksaan sudah berjalan cukup efektif dalam memberi efek jera kepada pelanggar. Faktor Sarana atau FasilitasFasilitas penunjang seperti CCTV, aplikasi pengaduan, dan kendaraan operasional tersedia, namun kendaraan sering rusak sehingga menghambat operasi. Dari sisi anggaran, meskipun ada peningkatan, honor untuk petugas lapangan Satpol PP masih belum tersedia, sehingga berdampak pada semangat kerja.Faktor MasyarakatPartisipasi masyarakat cukup baik, ditandai dengan pelaporan pelanggaran dan saling mengingatkan soal jam buang sampah. Kesadaran hukum meningkat, terbukti dari penurunan jumlah pelanggaran setiap tahun. Peran tokoh masyarakat dan sosialisasi pemerintah menjadi faktor pendukung utama. Faktor KebudayaanBudaya bersih masyarakat Manado mendukung kepatuhan terhadap perda. Masyarakat lokal umumnya patuh, tetapi pendatang masih ada yang belum memahami aturan. Kesadaran hukum terbentuk dari nilai sosial dan edukasi pemerintah, namun perlu sosialisasi lanjutan agar lebih merata. Kesimpulan: Kesimpulan dari penelitian ini adalah bahwa penegakan Perda Nomor 1 Tahun 2021 tentang Pengelolaan sampah di Kota Manado sudah di jalankan dengan baik tetapi masih adanya hambatan yang ditemukan dan diperlukannya peningkatan untuk mengatasi hambatan dalam penegakan Perda persampahan di Kota Manado Kata kunci: , Ketertiban Umum, Kota Manado, Penegakan Perda, Pengelolaan Sampah, Satpol PP.
