Abstract

Penelitian ini bertujuan untuk menganalisis, mengidentifikasi, dan menjelaskan bagaimana penegakan Peraturan Daerah tentang Pengendalian dan Pengawasan Minuman Beralkohol di Kota Semarang mulai dari bagaimana penegakan peraturan daerah itu sendiri, faktor yang menghambatnya, serta langkah yang dapat dilakukan untuk menyelesaikan masalah. Teori yang digunakan dalam penelitian ini adalah Teori Penegakan dari Soerjono Soekanto. Penelitian ini juga menggunakan metode penelitian deskriptif yang pengumpulan datanya melalui wawancara, observasi, dan dokumentasi. Hasil penelitian dari Penegakan Peraturan Daerah Nomor 5 Tahun 2023 menunjukkan bahwa masih ada hambatan dalam menegakan peraturan daerah tersebut seperti kurangnya anggaran, sarana dan prasarana, terbatasnya SDM, kurangnya kesadaran anggota Satuan Polisi Pamong Praja dan masyarakat, minimnya sosialisasi perda tersebut, serta tidak adanya warga yang melapor tentang penjual minuman alkohol ilegal. Adapun upaya mengatasi kendala ialah dengan penambahan anggaran, perbaikan sarana dan prasarana, peningkatan jumlah dan kualitas SDM, sosialisasi dengan peraturan daerah terkait, publikasi instansi, dan komunikasi persuasif kepada masyarakat. Kesimpulan dari penelitian ini yakni bahwa penegakan peraturan daerah tersebut masih belum optimal karena adanya beberapa faktor penghambat. Namun demikian, peningkatan penegakan peraturan dapat dilakukan melalui upaya-upaya dari internal dan eksternal instansi terkait. Kata kunci: penegakan, peraturan daerah, minuman beralkohol This research aims to analyze, identify, and explain how the Regional Regulations regarding the Control and Supervision of Alcoholic Drinks are enforced in the City of Semarang, starting from how the regional regulations themselves are enforced, the factors that hinder them, as well as the steps that can be taken to resolve the problem. The theory used in this research is the Enforcement Theory from Soerjono Soekanto. This research also uses descriptive research methods which collect data through interviews, observation and documentation. The results of research from the Enforcement of Regional Regulation Number 5 of 2023 show that there are still obstacles in enforcing these regional regulations such as lack of budget, facilities and infrastructure, limited human resources, lack of awareness of members of the Civil Service Police Unit and the community, minimal socialization of these regulations, and the absence of residents. who reported about illegal alcohol sellers. Efforts to overcome these obstacles include increasing the budget, improving facilities and infrastructure, increasing the number and quality of human resources, familiarizing with relevant regional regulations, agency publications, and persuasive communication to the public. The conclusion from this research is that enforcement of regional regulations is still not optimal due to several inhibiting factors.
