Abstract

ABSTRACT Background: Law enforcment is important for Indonesian society that can create a fair, orderly, and prosperous society. The implementation of billboards needs more attention because its implementation can have positive and negative impacs on Bandung City itself. Satpol PP as the duty bearer and has the authority to enforce the regional regulation is expected to implement all applicable provinsions in the regional regulation that has been determined. Purpose: The purpose of this study is to describe and analyse the enforcement of local regulations in the implementation of billboards by Satpol PP, supporting factors and inhibiting factors as well as efforts made to overcome obstacles in Bandung City, West Java Province. Methods: This study uses the theory of law enforcement from Moeljatno (2009), which has three dimensions, namely, rules, methods of curbing and implementing penalties. The approach used in this research is descriptive qualitative with an inductive approach. Conclusion: The results show that the enforcement of local regulations in the implementation of billboards by Satpol PP is good but not all written sanctions have been implemented, namely criminal sanctions. Furthermore, there are supporting factors for the enforcement of local regulations in the implementation of billboards, namely assistance from public complaint reports and the regulation itself as the legal basis. The inhibiting factors are that there are still many people who lack legal awareness and the lack of effective implementation of coordination carried out by various institution incorporated in the billboard technical team. Keywords: Enforcement, Satpol PP, Advertising. 2 ABSTRAK Latar Belakang: Penegakan hukum merupakan hal yang penting bagi masyarakat Indonesia yang dapat menciptakan masyarakat yang adil, tertib, dan sejahtera. Penyelenggaraan reklame perlu perhatian lebih karena penyelenggaraannya dapat memberikan dampak positif dan negatif bagi Kota Bandung sendiri. Satpol PP sebagai pengemban tugas dan mempunyai kewenangan untuk menegakan Peraturan Daerah diharapkan bisa mengimplementasikan semua ketentuan yang berlaku pada perda yang sudah ditetapkan. Tujuan: Tujuan dari penelitian ini ialah untuk mendeskripsikan dan menganalisis penegakan peraturan daerah dalam penyelenggaraan reklame oleh Satpol PP, faktor pedukung dan faktor penghambat serta upaya yang dilakukan untuk mengatasi hambatan di Kota Bandung Provinsi Jawa Barat. Metode: Penelitian ini menggunakan teori penegakan hukum dari Moeljatno (2009), yang memiliki tiga dimensi yaitu, aturan, metode penertiban dan pelaksanaan hukuman. Adapun pendekatan yang digunakan pada penelitian ini ialah deskriptif kualitatif dengan pendekatan induktif. Kesimpulan: Hasil penelitian menunjukkan bahwa penegakan peraturan daerah dalam penyelenggaraan reklame oleh Satpol PP sudah baik namun belum semua sanksi yang tertulis dilaksanakan, yaitu sanksi pidana. Selanjutnya terdapat faktor pendukung penegakan perda penyelenggaraan reklame yaitu bantuan dari laporan pengaduan masyarakat dan peraturan itu sendiri sebagai dasar hukumnya. Faktor penghambatnya yaitu masih banyaknya masyarakat yang kurang kesadaran hukum dan kurang efektifnya pelaksanaan koordinasi yang dilakukan oleh berbagai instansi yang tergabung dalam tim teknis reklame.
