Abstract

ABSTRAK Permasalan mengenai hewan ternak (sapi) yang berkeliaran bebas tanpa diawasi pemiliknya sudah sejak lama terjadi di Kecamatan Mamuju. Dampak dari masalah ini yaitu gangguan terhadap ketentraman dan ketertiban umum di masyarakat contohnya perumahan dan jalan raya. Menyingkapi permasalahan tersebut Pemerintah Kabupaten Mamuju menerbitkan Peraturan Bupati Nomor 21 Tahun 2021 Tentang Perubahan Atas Peraturan Bupati Nomor 34 Tahun 2018 Tentang Penertiban Hewan Ternak yang diharapkan masalah ini dapat terselesaikan. Namun sampai saat ini masih banyak dijumpai hewan ternak (sapi) yang berkeliaran di tempat umum bahkan menyebabkan kerusakan harta benda dan kecelakaan lalu lintas. Penelitian ini bertujuan untuk melihat bagaimana Penegakan Peraturan Kepala Daerah yaitu Peraturan Bupati Nomor 21 Tahun 2021 Tentang Perubahan Atas Peraturan Bupati Nomor 34 Tahun 2018 Tentang Penertiban Hewan Ternak, faktor penghambat serta upaya untuk mengatasi faktor penghambat tersebut. Metode penelitian yang digunakan metode kualitatif dengan pendekatan studi kasus. Teknik pengumpulan data adalah observasi partisipan, observasi langsung, wawancara, dokumentasi, arsip dokumen, dan perangkat fisik. Hasil penelitian ini menunjukkan bahwa Peraturan Bupati Nomor 21 Tahun 2021 Tentang Perubahan Atas Peraturan Bupati Nomor 34 Tahun 2018 Tentang Penertiban Hewan Ternak belum berjalan dengan efektif dan maksimal. Hal ini dapat dilihat berdasarkan teori Penegakan Hukum oleh Soerjono Soekanto, yang dapat disimpulkan bahwa penegakan peraturan ini sudah dilakukan akan tetapi belum maksimal dikarenakan kompetensi SDM yang tidak terampil dalam menertibkan sapi, peralatan yang kurang memadai, dan kurangnya kesadaran masyarakat terhadap hukum yang berlaku dikarenakan budaya masyarakat yang memang sudah dari dahulu melepas liarkan hewan ternaknya. The impact of this problem is a disturbance of peace and public order in society, for example housing and highways. Responding to this problem, the Mamuju Regency Government issued Regent Regulation Number 21 of 2021 concerning Amendments to Regent Regulation Number 34 of 2018 concerning Control of Livestock which it is hoped that this problem can be resolved. However, until now there are still many livestock (cows) roaming in public places and even causing property damage and traffic accidents. This study aims to see how the Regional Head Regulations are enforced, namely Regent Regulation Number 21 of 2021 concerning Amendments to Regent Regulation Number 34 of 2018 concerning Control of Livestock, the inhibiting factors and efforts to overcome these inhibiting factors. The research method used is qualitative method with a case study approach. Data collection techniques are participant observation, direct observation, interviews, documentation, document archives, and physical devices. The results of this study indicate that Regent Regulation Number 21 of 2021 concerning Amendments to Regent Regulation Number 34 of 2018 concerning Control of Livestock has not been running effectively and optimally. This can be seen based on the Law Enforcement theory by Soerjono Soekanto, which can be concluded that the enforcement of this regulation has been carried out but has not been maximized due to unskilled human resource competence in controlling cattle, inadequate equipment, and lack of public awareness of applicable laws due to culture people who have long since released their livestock.
