Abstract
ABSTRACT Problem/Background (GAP): Legal Drafting is the basic principle regarding the drafting process of policies in legislation by containing academic papers from the results of scientific studies and preliminary texts on regulations on legislation that are proposed in the framework of the formation of laws and regulations. The author focuses on the problem that there is no legal drafter at the Secretariat of the Jambi Provincial People's Representative Council and in the drafting and formation of Jambi Province regional regulations and still uses legislative experts from the Jambi Provincial People's Representative Council so that there is still a weak understanding of the technical drafting of regional regulations which results in repeated revisions. Purpose: The purpose of this study was to determine how the Implementation of the Drafting of the Jambi Provincial Regional Regulation on the Implementation of Population Administration at the Regional people's representative council of Jambi Secretariat and seen from the obstacles and support as well as efforts made to overcome implementation obstacles. Methods: The research method used is descriptive qualitative research method with an inductive approach. The data collection techniques used were interviews, observation and documentation. Data analysis techniques are data reduction, data presentation and conclusion drawing. The focus of this research is using Van Meter and Van Horn's theory, namely Standards and Objectives, Resources, Characteristics of the Implementing Organization, Attitudes of Implementers, Related Organizational Communication and Implementation Activities, and the Social, Economic and Political Environment. Results: Based on the results of the study, it shows that the implementation of the preparation of the Jambi Provincial Regional Regulation Draft on the Implementation of Population Administration at the Regional people's representative council of Jambi Province Secretariat generally runs quite well, but there are still obstacles in the preparation and drafting which cause ineffectiveness and efficiency and less than optimal preparation of these regional regulations. There has been good program cooperation between the internal Secretariat of the Regional people's representative council of Jambi Province Secretariat and external parties such as the Jambi Provincial Secretariat Legal Bureau and harmonization with the Jambi Representative Office of the Ministry of Law and Human Rights in the legal drafting of the draft Jambi Provincial Regional Regulation by making efforts to improve. There are supports and obstacles in the implementation of the drafting of the Jambi Province Regional Regulation on the Implementation of Population Administration at the Regional people's representative council of Jambi Secretariat. The supporters are the existence of experts who have a legal academic background, the availability of a sufficient and adequate budget and the efforts to improve and support from the Chairman of the Regional people's representative council of Jambi, Members of the Regional people's representative council of Jambi, along with the Regional people's representative council of Jambi Secretary and staff. Meanwhile, the obstacles are limited human resources, namely the unavailability of a Legal Drafter at the Regional people's representative council of Jambi Secretariat, the unavailability of a Legal Drafter procurement budget and the preparation and drafting of regional regulations that are not effective and efficient. Conclusion: Implementation of the preparation of the Jambi Provincial Regional Regulation Draft on the Implementation of Population Administration at the Regional people's representative council of Jambi Province Secretariat generally runs quite well, but there are still obstacles in the preparation and drafting which cause ineffectiveness and efficiency and less than optimal preparation of these regional regulations. Keywords: Implementation, Draft Regional Regulation, Legal Drafting ABSTRAK Permasalahan/Latar Belakang (GAP): Legal Drafting ialah prinsip dasar mengenai roses penyusunan pada kebijakan dalam perundang-undangan dengan berisikan mengenai naskah akademik dari hasil dalam kajian ilmiah serta naskah awal pada peraturan pada perundang-undangan yang dilakukan pengusulan pada rangka pembentukan dalam peraturan perundang-undangan. Penulis berfokus pada permasalahan yang mana Tidak tersedianya Legal drafter di Sekretariat Dewan perwakilan Rakyat Daerah Provinsi Jambi dan didalam perancangan serta pembentukan peraturan daerah Provinsi Jambi dan masih menggunakan tenaga ahli legislatif Dewan Perwakilan Rakyat Daerah Provinsi Jambi sehingga masih lemahnya pemahaman teknis penyusunan peraturan daerah yang mengakibatkan terjadinya revisi yang berulang-ulang. Tujuan: Tujuan dari penelitian ini adalah untuk mengetahui bagaimana Pelaksanaan Penyusunan Rancangan Peraturan Daerah Provinsi Jambi Tentang Penyelenggaraan Administrasi Kependudukan Pada Sekretariat DPRD Provinsi Jambi serta dilihat dari hambatan dan dukungan serta upaya yang dilakukan untuk mengatasi hambatan implementasi. Metode: Metode penelitian yang digunakan adalah metode penelitian kualitatif deskriptif dengan pendekatan induktif. Adapun teknik pengumpulan data yang dilakukan adalah wawancara, observasi dan dokumentasi. Teknik analisis data yaitu reduksi data, penyajian data dan penarikan kesimpulan. Fokus dalam penelitian ini yaitu menggunakan teori Van Meter dan Van Horn yaitu Standar dan Tujuan, Sumber Daya,Karakteristik Organisasi Pelaksana, Sikap Para Pelaksana,Komunikasi Organisasi Terkait dan Aktivitas Pelaksanaan, dan Lingkungan Sosial, Ekonomi dan Politik. Hasil/Temuan: Berdasarkan hasil penelitian menunjukkan bahwa Pelaksanaan Penyusunan Rancangan Peraturan Daerah Provinsi Jambi Tentang Penyelenggaraan Administrasi Kependudukan Pada Sekretariat DPRD Provinsi Jambi secara umum berjalan dengan cukup baik, namun masih terdapat hambatan didalam penyusunan dan perancangannya yang menyebabkan tidak efektif dan efisiennya serta kurang optimalnya penyusunan peraturan daerah tersebut. Telah Kerjasama program yang baik antara internal Sekretariat DPRD Provinsi Jambi dan eksternal seperti Biro Hukum Setda Provinsi Jambi dan harmonisasi dengan Kantor Perwakilan Kementerian Hukum dan Ham Jambi dalam penyusunan legal drafting rancangan peraturan daerah Provinsi Jambi dengan cara melakukan upaya-upaya pembenahan. Terdapat dukungan dan hambatan dalam pelaksanaan Pelaksanaan Penyusunan Rancangan Peraturan Daerah Provinsi Jambi Tentang Penyelenggaraan Administrasi Kependudukan Pada Sekretariat DPRD Provinsi Jambi. Pendukungnya yaitu Terdapat tenaga ahli yang memiliki latar belakang akademisi hukum, tersedianya Anggaran yang cukup dan memadai serta adanya upaya pembenahan dan dukungan dari Ketua DPRD Provinsi Jambi, Anggota DPRD Provinsi Jambi, beserta Sekretaris DPRD Provinsi Jambi dan jajaran. Sedangkan hambatannya adalah Keterbatasan sumber daya manusia yaitu tidak tersedianya Legal Drafter pada Skeretariat DPRD Provinsi Jambi, tidak tersedianya anggaran pengadaan Legal Drafter serta penyusunan dan perancangan peraturan daerah belum efektif dan efisien.
